Terms of Service

Dollar Stitch Club (“we”, “us”, “our”) is an AI-powered cross stitch pattern generation service operated by Rosemary Neil trading as Dollar Stitch Club, New South Wales, Australia (“the Service”). By creating an account or using the Service, you (“User”, “you”) agree to be bound by these Terms of Service.

If you do not agree to these terms, you must not use the Service.

You must be at least 13 years of age to use Dollar Stitch Club. If you are under 18, you confirm that you have your parent or guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these requirements.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@dollarstitchclub.com if you suspect any unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or abusively.

New accounts receive 7 free pattern generations as a one-time welcome gift. These do not roll over and cannot be transferred.

After your free patterns are used, continued use of the Service requires an active monthly subscription. Subscriptions renew automatically each month until cancelled. Your generation allowance resets at the start of each billing cycle and unused generations do not carry over.

You may cancel your subscription at any time. Access continues until the end of the current billing period.

Payments are processed securely by Lemon Squeezy. We do not store your payment card details.

We offer a full refund within 7 days of your subscription payment if you have not generated any patterns in that billing period. If you do not meet these conditions but believe you are entitled to a refund, please contact us at hello@dollarstitchclub.com and we will review your case. Refunds outside these conditions are granted at our sole discretion.

We reserve the right to change subscription pricing at any time. Existing subscribers will be notified of price changes at least 14 days in advance.

You agree not to use the Service to:

• Generate patterns containing illegal, obscene, hateful, defamatory, or harmful content.
• Infringe the intellectual property rights of any third party (e.g. submitting trademarked logos or copyrighted artworks you do not own).
• Attempt to reverse-engineer, scrape, or systematically extract data from the Service.
• Resell or redistribute access to the Service to third parties.
• Use automated tools or bots to generate patterns at scale beyond your plan limits.
• Engage in any activity that disrupts or harms the Service or other users.

We reserve the right to remove content and suspend accounts that violate these rules without prior notice.

Your prompts and uploads: You retain ownership of any prompts or images you submit. By submitting them, you grant us a limited, non-exclusive licence to process them solely to provide the Service to you.

Generated patterns — Personal Use (Hobby plan): You receive a personal, non-commercial licence to use generated patterns for personal cross stitch projects only. You may not sell, distribute, or commercially exploit patterns generated under a Hobby subscription.

Generated patterns — Commercial Use (Pro & Extended plans): You receive a non-exclusive commercial licence to sell finished stitched items and/or the PDF patterns themselves, including under your own branding. This licence remains active for as long as your Pro or Extended subscription is active. This licence does not grant you the right to sublicense or resell the underlying AI generation technology.

Our platform: All code, design, branding, and underlying technology of Dollar Stitch Club remains our exclusive intellectual property. Nothing in these Terms transfers any ownership of our platform to you.

Patterns are generated using third-party AI services. We do not guarantee that any generated pattern is wholly original or free from similarity to existing works. You are responsible for ensuring that your use of generated patterns complies with applicable law.

We make no warranty that prompts will produce any specific result. Pattern quality may vary depending on the complexity of the prompt, chosen size, and Aida count.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.

To the maximum extent permitted by applicable law, Dollar Stitch Club shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for any claim arising from these Terms or the Service shall not exceed the total amount you paid us in the 3 months preceding the claim.

The Service integrates with third-party providers including Supabase (authentication & database), Lemon Squeezy (payments & subscriptions), and AI image generation APIs. Your use of the Service is also subject to those providers' terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.

You may close your account at any time via your Account page or by contacting us at hello@dollarstitchclub.com. Upon account closure, your right to use the Service ceases immediately and all saved patterns are permanently and irrecoverably deleted. We strongly recommend downloading all patterns you wish to keep before closing your account.

We may terminate or suspend your account immediately if you breach these Terms. No refund will be issued for the remaining portion of any active subscription period in such cases.

Your generated patterns are stored securely on our servers for as long as your account remains active. We recommend downloading your patterns regularly as a personal backup.

Accounts with no activity for 6 consecutive months are considered inactive. We reserve the right to permanently delete the stored patterns of inactive accounts after this period.

Dollar Stitch Club is not liable for any loss of data resulting from account inactivity, account closure, or circumstances beyond our reasonable control.

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
